1. Introduction and Agreement
1.1. Acceptance of Terms: This document outlines the terms and conditions that govern your use of the MYK LATICRETE India Pvt. Ltd. website (the “Site”), and all associated online services, content, applications, and tools (collectively, the “Services”). By accessing, browsing, registering for, or using the Site or Services, you explicitly represent that you have read, understood, and irrevocably agree to be bound by these Terms of Use (“Terms”), the Privacy Policy , and all applicable laws and regulations.
1.2. Governing Contract: These Terms constitute a legally binding and enforceable contract between you and MYK LATICRETE. If you do not agree to all of these Terms, you are expressly prohibited from using the Site and Services and must discontinue use immediately.
1.3. Capacity to Contract: You affirm that you are at least 18 years of age, or the legal age of majority in your jurisdiction, and are otherwise capable of entering into this legally binding agreement.
1.4. Modifications to Terms: We reserve the unilateral right to revise, update, or change these Terms at any time. All changes are effective immediately upon posting to the Site. Your continued use of the Site and Services following the posting of revised Terms constitutes your full acceptance of the revised Terms.
2. User Accounts and Security
2.1. Registration and Access: Certain Services (e.g., personalized dashboards, technical downloads, product recommender results) may require you to register an account. You agree to provide accurate, current, and complete information during the registration process and to maintain and promptly update your information.
2.2. Account Confidentiality: You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to immediately notify MYK LATICRETE of any unauthorized use of your password or account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.
2.3. Accuracy of Information: You represent and warrant that any information you provide through the Site (including queries, calculations, or project details) is accurate and complete. We rely on the information you provide and are not responsible for any issues resulting from inaccurate or incomplete data submitted by you.
3. Intellectual Property Rights and Limited License
3.1. Ownership: The Site, Services, and all content, materials, algorithms, software, technical data sheets (TDS), architectural drawings, product guides, graphics, logos, images, and the compilation thereof are the proprietary property of MYK LATICRETE India Pvt. Ltd., its joint venture partners (MYK Group and LATICRETE International), and licensors, and are protected by Indian and international copyright, patent, trademark, and trade secret laws.
3.2. Trademarks: The name “MYK LATICRETE,” the LATICRETE logo, and all related names, logos, product names, designs, and slogans are trademarks of MYK LATICRETE, LATICRETE International, or their affiliates. You must not use such marks without prior written permission.
3.3. Limited License Grant: We grant you a limited, non-exclusive, non-sublicensable, and revocable license to access and use the Site and Services solely for your internal, personal, or non-commercial informational purposes, subject strictly to these Terms. This license does not include any right to:
* Reproduce, modify, distribute, or publicly display any Site content, except as explicitly permitted.
* Use any data mining, robots, or similar data gathering and extraction methods.
* Download any portion of the content other than as necessary for ordinary viewing or for downloads expressly provided for (e.g., TDS files).
4. Site Content, Calculators, and Product Disclaimers
4.1. Informational Nature: All technical information, including Adhesive Coverage Calculators, Grout Coverage Calculators, and product selection guides, are provided based on standardized testing conditions and theoretical calculations. These outputs are estimations and tools for rough planning only.
4.2. No Guarantee of Specific Results: MYK LATICRETE makes no guarantee that the estimated product quantities or installation methods generated by the Services will precisely match your actual on-site requirements. Factors such as substrate porosity, wastage, trowel technique, site conditions, and ambient temperature will affect actual consumption and performance.
4.3. Product Usage Risk: You acknowledge and agree that the correct application, site preparation, and proper curing of construction chemicals are critical to product performance. It is your sole responsibility, or the responsibility of your professional contractor, to verify the suitability of the product, adhere strictly to the published TDS/MSDS, and follow proper construction practices. We bear no responsibility for product failures due to incorrect application or site conditions.
4.4 No Professional Advice: Nothing contained on this website constitutes direct engineering, architectural, construction or other professional advice and cannot be constituted or regarded as substitute for professional advice.
4.5 The Site may contain links to third-party websites or resources. MYK LATICRETE has no control over and assumes no responsibility for the content, accuracy, availability, or practices of such third-party websites. Accessing third-party links is at your own risk. You acknowledge and agree that MYK LATICRETE shall not be responsible or liable, directly or indirectly, for any damage, loss, or harm caused or alleged to be caused by or in connection with your access to, use of, or reliance upon any content, goods, services, advertisements, materials, or practices available on or through any third-party website or resource.
5. Prohibited Activities and User Submissions
5.1. General Restrictions: You may not access or use the Site or Services for any purpose that is illegal or prohibited by these Terms. Prohibited activities include, but are not limited to:
* Harmful Access: Circumventing or disabling any security-related features of the Site.
* Automated Interaction: Using automated scripts to collect information from or interact with the Site.
* Unauthorized Commercial Use: Selling or otherwise transferring your profile or account.
* Defamation/Harassment: Posting or transmitting content that is defamatory, abusive, or obscene.
* Security Offences: Committing any offence under the Information Technology Act, 2000, including but not limited to unauthorized data alteration, denial of service attacks, or disseminating malicious code.

User-Generated Content: If the Site allows you to post or upload any content (e.g., comments, testimonials), you grant MYK LATICRETE a perpetual, royalty-free, irrevocable, worldwide, non-exclusive license to use, reproduce, modify, publish, and distribute such content in any media. You represent that you own or have the necessary rights to all such content.
6. Termination and Suspension
6.1. Termination by MYK LATICRETE: We reserve the right, without notice and at our sole discretion, to terminate or suspend your right to access and use the Site or Services for any reason, including, without limitation, a breach of these Terms.
6.2. Effect of Termination: Upon termination, all rights granted to you under these Terms will immediately cease. Sections relating to Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law shall survive termination.
7. Disclaimer of Warranties (Expanded)
7.1. As-Is Basis: THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. MYK LATICRETE EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
7.2. No Warranty of Error-Free Operation: WE DO NOT WARRANT THAT THE SITE WILL FUNCTION UNINTERRUPTED, SECURELY, OR ERROR-FREE. WE DO NOT WARRANT THAT DEFECTS WILL BE CORRECTED OR THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
7.3. Reliance on Content: YOU ACKNOWLEDGE THAT ANY RELIANCE UPON ANY ADVICE, OPINION, STATEMENT, OR INFORMATION DISPLAYED OR DISTRIBUTED THROUGH THE SITE IS AT YOUR SOLE RISK.
8. Limitation of Liability (Expanded)
8.1. Exclusion of Damages: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYK LATICRETE INDIA PVT. LTD., ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL, OR EXEMPLARY DAMAGES WHATSOEVER (INCLUDING LOSS OF REVENUE, PROFITS, GOODWILL, DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH:
* YOUR USE OR INABILITY TO USE THE SITE OR SERVICES.
* ANY ERRORS OR INACCURACIES IN THE CONTENT, CALCULATIONS, OR TECHNICAL DATA PROVIDED ON THE SITE.
* ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY PERSONAL INFORMATION OR FINANCIAL INFORMATION STORED THEREIN.
8.2. Maximum Liability: NOTWITHSTANDING ANY DAMAGE THAT YOU MIGHT INCUR, THE ENTIRE LIABILITY OF MYK LATICRETE AND ANY OF ITS SUPPLIERS UNDER ANY PROVISION OF THESE TERMS SHALL BE LIMITED TO THE GREATER OF THE AMOUNT PAID BY YOU TO MYK LATICRETE FOR THE SERVICES IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY OR ONE THOUSAND INDIAN RUPEES (INR 1,000).
9. Indemnification
You agree to defend, indemnify, and hold harmless MYK LATICRETE India Pvt. Ltd., its parent companies, subsidiaries, affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from:
- Your use of and access to the Site or Services.
- Your violation of any term of these Terms.
- Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
- Any claim that your use of the Services caused damage to a third party.
10. Governing Law and Dispute Resolution
10.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
10.2. Jurisdiction: You agree that any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the courts located in Hyderabad, Telangana, India, and you hereby consent to the personal jurisdiction and venue therein.
11. Miscellaneous Provisions
11.1. Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and MYK LATICRETE concerning the use of the Site and Services.
11.2. Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
11.3. Non-Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Failure by MYK LATICRETE to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
11.4. Force Majeure: MYK LATICRETE shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond MYK LATICRETE’s reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation (e.g., “line-noise” interference).
